1. This application will automatically collect information about your device and its location. Location information is required to take full advantage of some features.
2. This application also may collect personal information from you directly. Some of it could be sensitive. We will share that information with others in order to provide you and your employer with our products and services.
3. You may choose to schedule appointments with vehicle-maintenance providers through this application. Information you share with them is subject to their privacy practices.
4. We will not share personal information collected via the application with unrelated companies for their marketing purposes.
5. Collected information will be processed in the United States and be subject to its laws.

The Xcelerate for Drivers native application (the "Application") is an electronic service provided by Element Fleet Management's Element Vehicle Management Services, LLC on its own behalf and behalf of its fleet-management-business affiliates ("Element"). Software, hosting and other functions and content may be provided by our service providers ("Service Providers"), other affiliated companies ("Affiliates"), or others in a business relationship with us ("Business Partners"). Business Partners may include, but are not limited to, Customers of Element or suppliers of goods and services to Element and its Customers ("Suppliers"). We are providing you with access to this Application because you are associated with an Element Customer ("Your Company").
This Statement describes the type of information Element may collect as a result of your use of the Application and what Element does with that information. This Statement applies solely to Element's electronic data collection from this Application and does not describe information collection, use, or sharing practices with respect to data or information that Element collects by any other means.
Information Collected Automatically
Element may collect and use technical information about the device you are using and about your use of the Application to facilitate use of and identify enhancements to, if any, (a) the Application and (b) our provision of services to Your Company. For example, we may collect information about device model, operating system and version, unique device identifier, serial number, device motion information, and mobile network information.
One specific purpose of the Application is to utilize electronic methods to determine the location of a device utilizing the Application. For example, if you permit the Application to access location services through the permission system used by your mobile operating system, the Application may collect and provide to Element the location of your device. While your operating system may allow you to opt out of location services, this will negatively impact the performance and utility of the Application and, regardless, the Application and Element may utilize other methods to determine your location.
Information Provided by Users
We may ask you for personal information about yourself or about another person in order to assist us in providing to you or Your Company requested products and services. If you are uncomfortable with providing any personal information about yourself or about another person, then please discuss the matter with Your Company.
We may ask you to provide, among other things, the following types of personal information about yourself and/or a data subject. Precisely which personal information will be requested depends on the specific product, service, or action:
Element may use de-identified and aggregated data (data that does not directly identify you that is compiled from various sources, including the Application) for its own business purposes, independent of you, encompassing any lawful business purpose such as, for example, research, market analysis, comparisons offered to other Element customers, or offering such data as a product or service.
Specifically related to the purchase or sale of a vehicle, Element may request that you download and upload certain documentation and/or files containing certain personal information, such as name, address, phone number, and applicable tax ID, as a requirement for such purchase or sale.
User Data Deletion
Users are permitted to submit requests related to Xcelerate account setup, login and data deletion at the following link: https://www.elementfleet.com/contact#driver. Any deletion requests submitted by Users is limited to login credentials, such as username, password and data security related information. Pursuant to agreements between Your Company and Element and applicable data privacy and security laws, Users may not request the deletion of User information such as name, email and phone number, as that information is owned by Your Company. Any such deletion requests related to name, email and phone number must be submitted by Your Company. If Element receives a proper deletion request, Element's Customer Technology department will notify Your Company (and User if necessary and applicable) via email to confirm the completion of any account deletion requests.
Personal information, about you or others, and other information arising from your use of the Application will be collected, processed, and used by us, our Service Providers, Affiliates, Business Partners and Your Company (and Your Company's affiliated or associated companies) for the purpose of providing our products and services and to facilitate the transactions you or Your Company enter into with us.
The Application allows you to schedule an appointment with vehicle-maintenance providers. We will share the information you provide when scheduling that appointment with that provider and do not control their use of the information.
We also may provide your information or information that you provide to us about a data subject to third parties in response to a request by a law enforcement authority, in order to comply with federal, state, or provincial laws or regulations, or when required or permitted by law or legal process, including a court order or subpoena. We are part of a global business and so information, including personal information, may be transferred to, processed, and held in the United States and in other countries. Processing in the United States is subject to its laws.
We may also aggregate information that we gather about our Customers, Suppliers, prospects, sales, traffic patterns, vehicles, and services and provide this information to Service Providers, Affiliates, and Business Partners in aggregate form; however, when we do, these data sets will not contain any personally identifiable information about you or a data subject if not supporting a product or service for you or Your Employer.
In the event that all or part of Element or all or part of its assets are acquired by, merged with, sold to, or otherwise disposed of to one of more third parties (including, without limitation, in the event of bankruptcy), your personally identifiable information and information that you have provided to us about a data subject may be among the items so transferred or disposed.
We do not share your personally identifiable information with unrelated companies for their marketing purposes.
The Application provides the capability to update certain information and contact Element with any questions. You may also contact representatives of Your Company. Certain websites operated by Element also may permit changes to information provided.
You may also request that Element discontinue maintenance and use of your personal information for the permitted purposes. Such a request, however, may not be fulfilled until there are no longer any remaining obligations between Element and Your Company concerning your company-provided vehicle, any fuel or maintenance charge card that may be provided to you, or any other related services we provide that renders retention of the information for a reasonable period of time advisable. Your request may also result in the termination of your eligibility for a company-provided vehicle.
We maintain physical, electronic, and administrative safeguards designed, under a risk-based approach, to guard your information. We seek to limit access to sensitive personal information about you solely to those who need it to provide or receive our products and services. No set of safeguards is perfect, however, and as set forth in the Application Terms of Use we do not guarantee or warrant the security of information provided.
This Privacy Statement only addresses the collection and disclosure of information we collect through the Application. The Application may include links to the applications or websites of others with whom we do not have a relationship, contractual or otherwise. The privacy practices of the operators of such websites and applications may be different from ours. We do not control the privacy policies of those parties, applications, or websites and cannot be sure whether any such third parties have privacy policies similar to ours.
We will provide notice in the Application of any material changes and will update this Statement to include any such change.
